1. Provider and Scope
These Terms and Conditions apply to the use of the Thumbpilot platform and all associated services.
The contracting party is Mustafa Yesilyayla, Kurt-Schumacher-Straße 76, 67663 Kaiserslautern, Deutschland.
2. Service Description
We provide digital services for AI-assisted creation and editing of thumbnail images and related image objects.
The exact scope of features may change for technical, security or product reasons, provided this is reasonable for users.
3. Registration and User Account
A user account is required for paid features. Users are obligated to provide truthful information during registration and to keep access credentials confidential.
4. Prices, Payment Processing and Small Business Status
The prices displayed at the time of purchase apply. Payment is processed via Stripe.
Due to small business status pursuant to § 19 UStG (German VAT Act), no VAT is charged or shown on invoices.
Invoice and tax-relevant billing data from payment processing is retained in accordance with statutory retention obligations, even if a user account is deleted.
5. Credits and Digital Services
Purchased credits can be used for the features offered. Credits are non-transferable and do not accrue interest.
In case of reversal (e.g. valid withdrawal, erroneous booking), already consumed service portions may be taken into account on a pro-rata basis.
Before purchasing digital credits that can be used immediately, we obtain explicit consent to early commencement of performance and confirmation of the possible loss of the right of withdrawal. These declarations are versioned and documented per transaction.
6. Usage Rights to Results
Subject to conflicting third-party rights, the user receives a simple, unlimited usage right in terms of time and territory for the generated results.
The user remains solely responsible for ensuring that the use and publication of generated content is legally permissible.
7. Prohibited Use
Prohibited in particular are unlawful, offensive, copyright-infringing, discriminatory or otherwise abusive content, as well as attempts to circumvent security mechanisms.
In case of violations, we may block content, restrict services or terminate accounts.
8. Availability and Technical Risks
We do not guarantee continuous, uninterrupted availability. Maintenance, further development, security measures or failures of third-party providers may lead to temporary restrictions.
9. Liability
We are fully liable in cases of intent and gross negligence, injury to life, body or health, and in accordance with mandatory statutory provisions.
In cases of slight negligence, we are only liable for breach of material contractual obligations and limited to typically foreseeable damage.
10. Duration and Termination
The user relationship runs for an indefinite period and may be terminated by either party at any time in accordance with statutory requirements.
11. Right of Withdrawal for Consumers
Consumers generally have a statutory right of withdrawal for distance contracts. Details can be found in our Cancellation Policy.
12. Applicable Law and Worldwide Use
German law applies to the exclusion of the UN Sales Convention (CISG), unless mandatory consumer protection provisions of the country in which the consumer has their habitual residence conflict with this.
For merchants and legal entities under public law, the place of jurisdiction is the provider's registered office, to the extent permitted by law.
13. Consumer Dispute Resolution
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Final Provisions
Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected.
